Domain Guard Terms and Conditions

  1. General

    The following terms and conditions (‘Terms’) govern the agreement for us (‘Fasthosts, we, us’) to provide the Domain Guard Service (‘Service’) to you (‘Customer’).

    These Terms are supplemental to, not in lieu of any other terms and conditions which may also apply to the provision of the Service, including but not limited to our Domain Name Terms and Conditions and General terms and Conditions, which are accessible here. In the event of conflict, these Terms shall apply.

    Fasthosts reserves the right to amend, modify or alter any of these Terms without your prior consent.

  2. Commencement, Term and Termination

    1. Once purchased, subject to clause 2.2 below, the Service will continue for 12 months (‘Initial Term,’) and thereafter, auto renew for subsequent 12 month terms (‘Renewal Term’) unless and until the Service is terminated by you.
    2. The Service can be cancelled at any time by you by following the instructions within your customer control panel. No refunds for any remaining Initial or Renewal Term will be given.
    3. Any and all enhanced security locks placed within your customer control panel as a result of the use of the Service will be removed at the end of the Term.

  3. Fees and Payment

    1. The fees for the Service are as published on the website at the time of purchase (‘Fees’).
    2. The Fees for the Initial and any subsequent Renewal Terms shall be paid in advance.

  4. Customer Obligations

    1. Once purchased, you must set your two factor authentication (2FA) and activate the Service on your eligible domain(s) (note, external domains are excluded).
    2. You acknowledge and accept that the 2FA is one component of the overall Service and Fasthosts makes no representation or warranty whatsoever that your use of the 2FA shall completely secure or mitigate threats to the hosted system (which shall include but is not limited to, your website and email). Furthermore, the Service will not prohibit any transfers of the domain at a registry level. Fasthosts support obligations described in these Terms are its sole and exclusive obligations regarding the 2FA element of the Service.
    3. Fasthosts has no responsibility, liability or other obligations in connection with failures resulting from or related to: (i) modifications made by you to the Service; (ii) modifications contrary to any documentation provided by us relating to the Service; or (iii) use in a manner other than as authorised under these Terms or as required by any documentation made available to you relating to the Services;
    4. You consent and shall procure your user’s consent to the collection, use, and disclosure of information provided by you to us associated with the Services in accordance with Fasthost’s Privacy Policy.

  5. Use of DNSSEC (Domain Name System Security Extensions)

    1. You acknowledge and agree that if the keys do not match, a visitor’s lookup of your website may fail (and result in a “website not found” error). We assume no liability or responsibility regarding the same. In addition, DNSSEC responses are authenticated, but not encrypted.
    2. You acknowledge and agree that by enabling DNSSEC, Fasthosts will digitally sign your domain names and submit the DNSSEC records to the corresponding registry and in turn, by disabling DNSSEC, Fasthosts will remove the digital signature on your domain names and submit the changes to the corresponding registry.

  6. Domain Registration Document

    1. This document is for informational purposes only and is issued by Fasthosts with the sole purpose of providing registration data for the domain at the date stated in the document. This document is not meant to guarantee any title of property to the domain but merely to demonstrate that the named individual or organisation was the registrant of the domain when the document was created. Data provided through this document is data obtained in real time, from the registrar or corresponding registries as specified by the registrant and Fasthosts does not give any guarantee or warranty as to its accuracy.
    2. You accept and agree to utilise the data contained herein for the purpose of identifying the named individual as the owner of the domain and not for any other purpose including facilitating the transmission of this data via electronic mail, telephone, facsimile of mass offers or to enable or carry out electronic, automated or large-scale processes to collect such data for any purpose, including obtaining this data for personal or commercial use.
    3. You agree to hold Fasthosts harmless and indemnify Fasthosts as well as its subsidiaries, affiliates, contractors, partners and parent companies against any liability for the use of this document by yourself, the registrant and any third party and that you agree to utilise this document in accordance with any regulations, laws or other rules regarding the subject of domain names as well as any other applicable law.
    4. You grant Fasthosts a non-exclusive, worldwide, irrevocable, fully sub-licensable license, at no charge and for an unlimited period of time, to save, duplicate, distribute, modify, display and publish the data within the domain registration document in connection with the service from Fasthosts.

  7. Fasthosts Rights and Obligations

    1. Fasthosts may reject, lock, or delete the Service if, in Fasthost's sole discretion, Fasthosts believes that the content or domain could result in a breach of these Terms or any other Fasthosts terms to which you are subject, breaches any applicable laws or may result in claims against Fasthosts and or its affiliates from third parties.
    2. Fasthosts may, in lieu of disabling access to the particular domain, disable or lock your account and shall not be under any obligation to reverse such action whilst, in Fasthosts opinion, you remain in breach of clause 7.1 above.
    3. Fasthosts reserves the right to refuse to provide the Services for any reason at its sole discretion.

  8. Limitation of Liability and Warranties

    1. EXCEPT AS SPECIFICALLY PROVIDED HEREIN AND IN THE GENERAL TERMS OF SERVICE, FASTHOSTS MAKES NO OTHER WARRANTIES WITH RESPECT TO THE SERVICES, WHICH ARE PROVIDED ON AN "AS IS" BASIS WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, NOR DOES FASTHOSTS MAKE ANY WARRANTY AS TO ANY RESULTS THAT MAY BE OBTAINED BY USE OF THE SERVICES. FASTHOSTS HEREBY EXPRESSLY DISCLAIMS ANY AND ALL WARRANTIES, INCLUDING WITHOUT LIMITATION: (1) ANY WARRANTIES AS TO THE AVAILABILITY, QUALITY, QUANTITY, OR CONTENT OF THE SERVICES PROVIDED TO YOU HEREUNDER; AND (2) ANY WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. YOU AGREE AND ACKNOWLEDGE THAT NO REPRESENTATIONS OF ANY KIND HAVE BEEN MADE TO YOU REGARDING THE POTENTIAL VOLUME OF VISITORS TO YOUR WEBSITE AS A RESULT OF YOUR PURCHASING THE SERVICES. THIS LIMITATION OF WARRANTIES IS IN ADDITION TO THE LIMITATION OF WARRANTIES SET FORTH IN THE FASTHOSTS GENERAL TERMS OF SERVICE.
    2. FASTHOSTS, ITS SUBSIDIARIES, AFFILIATES, LICENSORS, SERVICE PROVIDERS, CONTENT PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, AND DIRECTORS WILL NOT BE LIABLE FOR ANY INCIDENTAL, DIRECT, INDIRECT, PUNITIVE, ACTUAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR OTHER DAMAGES, INCLUDING LOSS OF REVENUE OR INCOME, EMOTIONAL DISTRESS, OR SIMILAR DAMAGES, EVEN IF FASTHOSTS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT WILL THE COLLECTIVE LIABILITY OF FASTHOSTS AND ITS SUBSIDIARIES, AFFILIATES, LICENSORS, SERVICE PROVIDERS, CONTENT PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, AND DIRECTORS TO ANY PARTY (REGARDLESS OF THE FORM OF ACTION, WHETHER IN CONTRACT, TORT, OR OTHERWISE) EXCEED THE GREATER OF £100 OR THE AMOUNT YOU HAVE PAID TO FASTHOSTS FOR THE APPLICABLE CONTENT OR SERVICE OUT OF WHICH LIABILITY AROSE.
    3. You will indemnify and hold Fasthosts, its subsidiaries, affiliates, licensors, content providers, service providers, employees, agents, officers, directors, and contractors (the ''Indemnified Parties'') harmless from any breach of these Terms or the Fasthosts General Terms and Conditions of Service by you, including any use of content relating to the Service other than as expressly authorised in these Terms or the Fasthosts General Terms and Conditions of Service. You agree that the indemnified parties will have no liability in connection with any such breach or unauthorised use, and you agree to indemnify any and all resulting loss, damages, judgments, awards, costs, expenses, and legal fees of the indemnified parties in connection therewith. You will also indemnify and hold the indemnified parties harmless from and against any claims brought by third parties arising out of your use of the information provided under the Service.
